These Terms of Service govern your use of the CASPIAN online store and your purchase of products from K8C CASPIAN D.O.O. BEOGRAD (VRAČAR). By using the website or placing an order, you agree to these Terms together with the policies referenced below. Mandatory rights granted to consumers by applicable law are not excluded or limited by these Terms.

2. Online store

We provide an online store for the presentation and sale of CASPIAN products and related information. The store is powered by Shopify. We may update, suspend or change website content and functionality when reasonably necessary, subject to any obligations under applicable law.

3. Eligibility and customer information

You must have the legal capacity required to enter into a purchase contract. When placing an order, you agree to provide accurate, complete and current information, including billing, delivery and contact details. You are responsible for keeping any customer account credentials confidential.

4. Products and product information

We aim to describe and present products accurately. Natural products may have reasonable variations in appearance, colour, texture or other characteristics. Images displayed on screens can also vary depending on device settings. Nothing in this section limits rights that apply when goods do not conform to the contract or are otherwise defective under mandatory law.

5. Orders and acceptance

Submitting an order is an offer to purchase the products shown in your order. An order becomes binding when it is accepted in accordance with the checkout and order-confirmation process. We may refuse or cancel an order where permitted by law, including in cases of payment failure, suspected fraud, obvious pricing or stock errors, or inability to supply the ordered product. Where an order is cancelled after payment has been collected, any amount due back to the customer will be handled in accordance with applicable law and our Refund Policy.

6. Prices, taxes and payment

Prices and any applicable charges are shown on the website and/or at checkout. Taxes, delivery fees or other charges are applied and displayed as required by applicable law and the selected delivery method. Payment is processed using the payment methods made available at checkout. You agree to provide valid payment information and to be authorised to use the selected payment method.

7. Shipping and delivery

Shipping methods, delivery terms and related conditions are governed by our Shipping Policy. Delivery estimates are estimates unless a binding delivery deadline is expressly stated or required by law.

8. Perishable food products

Caviar is a perishable food product and should be handled, stored and consumed in accordance with the product label, storage instructions and any instructions supplied with the order. Customers are responsible for following those instructions after delivery. This does not limit rights relating to products that were damaged, defective, incorrectly supplied or otherwise non-conforming at the time required by law.

9. Returns, complaints and refunds

Returns, complaints and refunds are governed by our Refund Policy. Because caviar is a perishable food product, rights of withdrawal or return may be excluded or limited where applicable law permits an exception for goods that are liable to deteriorate or expire rapidly, or where other food-safety or hygiene exceptions apply. Mandatory rights concerning defective, damaged, incorrectly supplied or non-conforming goods remain unaffected.

10. Intellectual property

Unless otherwise stated, the website and its original text, graphics, photographs, logos, product presentation and other content are owned by or licensed to CASPIAN and are protected by applicable intellectual property laws. You may use the website for personal and lawful purposes. You may not reproduce, distribute, commercially exploit or create derivative works from protected website content without permission, except where permitted by law.

11. Reviews, messages and submitted content

If the website allows you to submit reviews, comments or other content, you must not submit unlawful, misleading, defamatory, infringing, harmful or malicious material. You remain responsible for content you submit and for having the rights needed to submit it.

12. Third-party services and links

The store may use or link to services operated by third parties, including payment, logistics, social media and other providers. Those third parties may apply their own terms and privacy notices. We are not responsible for independent third-party services except to the extent responsibility cannot lawfully be excluded.

Personal information is handled in accordance with our Privacy Policy. Shopify and other service providers may also process information in accordance with their own applicable privacy terms.

14. Website availability and prohibited use

You may not misuse the website, interfere with its security, introduce malicious code, attempt unauthorised access, use the website for unlawful purposes, or infringe the rights of CASPIAN or any third party. We may take reasonable measures to protect the website and other users.

15. Liability

To the maximum extent permitted by applicable law, CASPIAN is not responsible for indirect or consequential losses that were not reasonably foreseeable or that result from events outside our reasonable control. Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by mandatory law, including mandatory consumer protection rights.

16. Governing law and disputes

These Terms are governed by the laws of the Republic of Serbia, without depriving consumers of any mandatory protections that apply to them under applicable law. The competent court or other dispute-resolution body will be determined in accordance with applicable law. We encourage customers to contact us first so that we can try to resolve any issue directly.

17. Changes to these Terms

We may update these Terms from time to time for operational, legal or regulatory reasons. The current version will be published on this page. Changes do not retroactively alter rights and obligations that have already arisen unless applicable law provides otherwise.
